Cisco accused Apple in a suit filed in United States District Court for the Northern District of California of willingly infringing its trademark when it announced the new iPhone at the Macworld Expo in San Francisco on Tuesday. Apple tried to get the rights to the iPhone name several times before but failed. Cisco and Apple are set to make a deal on a way they can both use the iPhone name. If Cisco goes to court with Apple, Apple is confident they will prevail. There are already several companies using the iPhone name, and Apple is the only one who is using it for a cell phone. Apple applied to use the trademark in the U.S. on September 26, 2006 using a Wilmington, Del.-based front company called Ocean Telecom Services.

However, with a price of $499 for just the 4GB version and a required two-year contract with Cingular, just how will the iPhone be able to compete.
